Local Land Charges terms and conditions for online searches

You must read and understand these terms and conditions before using LLCSearches.co.uk (the Services) to request a search from BCP Council.

By requesting a search or using the Services, you agree to be legally bound by the published terms and conditions at the time of request. You can only request the Services if you are eligible to enter a contract and are at least 18 years old.

The Services is subject to availability and allows at no added cost (compared to sending searches by post or email) speeding up the submission and as a result the return of local land charges searches. The Services do not provide you access to databases or information to compile the local land charges search results or replies to enquiries of local authorities.

2. Registration

2.1 You must register with us by completing the registration on the LLCSearches.co.uk website.

2.2 It is your responsibility to ensure that any information or specification you supply is correct.

2.2 We can refuse or suspend access to the Services within our sole discretion.

3. Information you supply

3.1 We may contact you for the purpose of your request by using e-mail or other electronic communications methods and by pre-paid post and you expressly agree to this.

3.2 You grant us, for the purpose of your search request, a non-exclusive, world-wide, perpetual, irrevocable, royalty-free license to use any information you provide to us during the registration or request.

3.3 Such information must be legal, decent, honest, and truthful, must not infringe any third party's rights, must not have any viruses or other malicious computer programming routines, and must not link to any other websites. Without limiting the above, all information you supply must be correct and complete and all registration details must have your name, address, and other requested details.

4. Security

4.1 Your privacy is critical to BCP Council. We respect your privacy and follow the General Data Protection Regulation about your personal information.

4.2 Your responsibility is to protect your username and password (given or set) and confidential emails or verification sent to you for use on the LLCSearches.co.uk website. You may not share these with or transfer them to any third parties. You must let us know at once of any unauthorised use of them or any other breach of security about the Services.

5. Availability of the LLCSearches.co.uk Website

DEF Software Limited hosts the LLCSearches.co.uk website and they endeavour to keep it available; we cannot guarantee that it will run continuously or without interruptions. This could affect applications for local land charges searches or the replies to such applications.

6. Payment

6.1 You can pay by BACS Transfer, Account or Cheque. Unless we have agreed for you to pay by account, we must first receive payment of the whole price for a Search before we release the results to you.

6.2 If you use BACS Transfer you must make it at the same time as your local land charge search request and quote the portal reference number in the BACS payment.

6.3 When you select for payment by Account, you are asking us to set up a credit account. We will contact you separately for details of how you wish to settle your account. Your account will be set up as soon as we accept your account registration.

7. Use of the Services

7.1 You may only use the Services for the making of applications for, and the delivery of the results of, local land charge searches and enquiries of local authorities in connection with the buying and selling of land or property

7.2 You will not resell the results of the local land charges searches or enquiries of local authorities without our prior written consent.

OR

You will use the data provided in the results of the Local Authority search solely in connection with the sale/purchase of the land/property, the subject of the search.

7.3 You acknowledge that the interpretation and use of the results of the local land charges searches, or enquiries of local authorities delivered to you as part of the Services is dependent upon the exercise of your own skill and judgment.

8. Cancellation

You may request to cancel a search submitted through the Services at any time up to the point of accepting the search request by making a written request to us at christchurch.locallandcharges@bcpcouncil.gov.uk. We reserve the right to decline your request. We will refund any sum paid if we accept the cancellation.

9. Delivery 

We will deliver the local land charge search results to the email address linked with your account as soon as possible after we have processed your request.

10. Termination

BCP Council has in its sole discretion the right to issue a warning, temporary suspension, or an indefinite suspension and termination of your rights to use the Service if you:

10.1 act inconsistently and in breach of these terms and conditions.

10.2 at any time violate or try to violate any rights of any other user of the Services or third party.

10.3 are engaged in any fraudulent activity.

10.4 do not make any payments due to us in accordance with these terms.

11. Compliance with laws

You agree to follow all applicable laws, statutes and regulations concerning your use of the Services.

12. General release

12.1 Your acceptance of these terms and conditions also acts as a general release of BCP Council (and all their officers, agents, and employees) from any liability for any claims, loss, and damages (both direct and indirect, including loss of profits, goodwill, and business opportunity) arising out of or in any way connected to your use of the Services and our website.

12.2 In addition, we make no representations or warranties about the accuracy, completeness, or suitability for any purpose of the information and related graphics published on the LLCSearches.co.uk website. From time to time our site may have technical inaccuracies or typographical errors. All liability of BCP Council arising for any such inaccuracies or errors is expressly excluded to the fullest extent allowed by law.

12.3 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have under the Local Land Charges Act 1975 or may have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

13. Trade marks, logos, etc

All trademarks, product names and company names or logos cited herein are the property of their respective owners. No permission is given BCP Council for the use of any such brand names, product names, titles, or copyrights.

14. Notices

Except as otherwise stated, any notices you wish to send to us should be e-mailed to christchurch.locallandcharges@bcpcouncil.gov.uk. We will display any notices that we may wish to draw to your attention on our website or the LLCSearches.co.uk website.

16. Applicable law

Every transaction on the Services is considered to be completed within the United Kingdom and therefore governed by in accordance with English law. The terms of this agreement (and any dispute, controversy, proceedings or claim of whatever nature in relation to them) shall be governed and interpreted by English law and the English courts shall have exclusive jurisdiction in relation thereto.

17. Events beyond our control

BCP Council will not be in breach of this agreement or otherwise liable for any delay in performance if to the extent that any delay or failure is due to the circumstances beyond its reasonable control and including, without limitation, strikes, lockouts and other industrial disputes, breakdown of systems or network access, flood, fire, explosion, or accident.

18. Invalidity

If any part of the terms of this agreement is unenforceable (including any provision in which we exclude our liability to you) it will not affect the enforceability of any other part of these conditions.

19. Entire agreement

This agreement, together with any document expressly referred to within its provisions, contains the entire agreement between us relating to the subject matter covered and supersedes any previous agreements, arrangements, undertakings or proposals, written or oral, between us in relation to such matters or any statements made to you by any person, including (without limitation) any of our employees or agents. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
